Exchange and return
Buyers have the right to return the goods — this is stated in the relevant legal acts. However, such products can only be returned if the following conditions are met:
Purchase of goods of proper quality. According to Art. 9 of the Law of Ukraine "On Protection of Consumer Rights", the consumer has the right, within 14 days, not counting the day of purchase, to replace a good quality product with a similar one if the product does not fit in shape, size, style, color or cannot be used for its intended purpose, if the product has not been used and its presentation, consumer qualities, seals, factory packaging, documents have been preserved. If the product is not available, the consumer has the right to purchase any other goods, get a refund in the amount of the cost of the returned goods, or exchange the goods for a similar one when the corresponding product first goes on sale.
Purchase of goods of inadequate quality. According to Art. 8 of the Law of Ukraine "On Protection of Consumer Rights" when identifying significant defects that arose due to the fault of the manufacturer of the product, during the warranty period the consumer has the right to replace the product or return the money. According to paragraph 12 of Article 1 of the Law of Ukraine "On Protection of Consumer Rights", a significant defect is a defect that makes it impossible or unacceptable to use the product in accordance with its intended purpose, arose due to the fault of the manufacturer, after its elimination appears again for reasons beyond the consumer's control and has at least one of the following features:
- it cannot be eliminated at all;
- its elimination will take more than 14 calendar days or repair is impossible within another period agreed upon by the parties
- it makes the product substantially different from that provided for in the contract.
The quality of the product, if necessary, can be checked with the help of an examination carried out by the Service Center authorized by the manufacturer, during which the fact of violation of the warranty conditions of the product operation by the consumer is established. The consumer's demand for replacement of the goods is subject to immediate satisfaction if available, and if not - within 2 months from the date of filing the application. If it is impossible to satisfy the demand within the specified period, the consumer has the right to choose to demand replacement of the defective goods with another product of a different brand (model) of proper quality with a corresponding recalculation of the price or a refund.
Recalculation of the cost is not made in the case of replacement of a defective product with a similar brand (model) of proper quality, the price of which has changed. In the case of replacement of a product with the same brand (model) of proper quality, the recalculation of the cost of the defective product in the event of a price increase is made based on its cost at the time of exchange, and in the event of a price decrease - based on the cost at the time of purchase.
When returning money for a product of proper quality, settlements with the consumer are made based on the cost of the product at the time of purchase. The money is returned on the day of filing the demand, and if it is impossible to return the money — no later than within 7 days.
Consumer claims are considered only if:
- a sales receipt confirming the purchase is presented;
- the goods are complete;
- factory packaging;
- the warranty card is available.
A product may be replaced or refunded only if all conditions and procedures are met.
A product may not be replaced or refunded if:
- more than 14 days have passed since the purchase of the goods, which do not have significant defects;
- the goods, which do not have significant defects, have been used and are not new;
- signs of outside interference (opening, attempted repair) were detected during the quality check of the goods, or other warranty service conditions have been violated;
- there is no document confirming the fact of purchase of the goods, or a warranty card, or the goods are complete
A refund for a product of inadequate quality is made on the day of the corresponding claim, and if a refund is impossible, no later than within 7 days. In the event of an increase in the price of the goods, the calculation is made based on its cost at the time of the corresponding claim, and in the event of a decrease in the price, based on the cost at the time of purchase of the goods.
Please note that in accordance with paragraph 3 of Article 4 of the Law of Ukraine "On Protection of Consumer Rights", the consumer is obliged to:
- before starting to use the product, carefully study the operating rules set out in the product documentation provided by the manufacturer (seller);
- before starting to use the product, contact the seller (manufacturer) or another person specified in the operating documentation who performs their functions with questions, if necessary, to clarify the terms and rules for using the product;
- use the product in accordance with its intended purpose and adhere to the conditions (requirements, norms, rules) established by the manufacturer of the product in the operating documentation;
- in order to prevent negative consequences for the consumer of the consequences of using the product, to adhere to the safety methods provided by the manufacturer in the product and the special rules provided in the operating documentation, and in the absence of such rules in the documentation — to adhere to the usual understandable safety methods established for a product of this kind.
